What is a CMP?

A Consent Management Platform (CMP) is a tool that supports companies in managing the consent of users to various data collection and processing processes. CMPs are particularly important in the context of the General Data Protection Regulation (GDPR) and other data protection laws, such as the ePrivacy Regulation or the California Consumer Privacy Act (CCPA). They ensure that websites and apps obtain user consent for certain tracking and marketing activities before data is processed. A CMP is often presented as a banner or pop-up that appears when you visit a website.

Why is a CMP used?

CMPs are necessary to fulfil legal requirements to protect the privacy and rights of users. Here are the main reasons why a CMP is used:

  1. Legal requirements: Many data protection laws, such as the GDPR in Europe, require companies to obtain explicit consent from users before processing personal data for advertising or analytics purposes. Without a CMP, companies risk high fines and legal consequences.

  2. Transparency and control for users: A CMP gives users control over what data they want to share. They can set their preferences for cookies, tracking tools and marketing activities and ensure that their data is only used for authorised purposes.

  3. Building trust: A well-implemented CMP promotes user trust in a website or app. By providing transparent information about data processing and giving users a choice, companies are perceived as responsible and data protection-conscious.

  4. Marketing optimisation: Even though CMPs have the potential to reduce the number of marketing activities consented to, they still help to obtain qualified consent. Consenting users are often more engaged and relevant to marketing activities, which leads to better results in the long run.

Prominent vs. non-prominent mode

TYRIOS supports the CMP in two different versions:

  • Discreet mode: in this mode, the CMP is displayed unobtrusively on the page. The user can operate the page without having to interact with the CMP. It is therefore less distracting and the user can interact with the page straight away. However, the non-prominent display also makes it less likely that the customer will agree to the marketing measures.

  • Prominent mode: Here, the CMP appears as a pop-up that must be displayed to users. Users must actively agree or decline before they can continue. This approach increases consent as users have to make a conscious decision, which can be crucial for marketing activities.

Legally compliant presentation of the CMP

There are a few points to consider in the prominent display:

  1. The decline function must be displayed just as prominently as the consent function. Only the necessary cookies may be set for the decline function.
  2. As the CMP is displayed in a pop-up that cannot be clicked away, the privacy policy and the legal notice must be linked separately in the pop-up. This is the only way to fulfil the legal requirements.

Solution:

By default, the CMP in TYRIOS runs in the discreet variant, as we are convinced that "cookie banners" are often annoying and user satisfaction suffers as a result. However, it only takes a few clicks to switch to this mode.

  1. Go to the customer area as a user with extended rights > System > Layout configuration
  2. Select the "Privacy banner" option
  3. Activate the "eye-catching banner"
  4. Provide the link to the legal notice and privacy policy

    Make sure that the link can be stored in a language-specific way. You should therefore store the English link in the English version to avoid a language change
