General newsletters usually have an advertising character, because they are not based on an existing transaction (transactional newsletter), but they want to create awareness for your company and your offer. Therefore, competition law forces you to obtain the customer's confirmation that he or she should really receive these general newsletters. The law explicitly states that it must be a double opt-in. This means that after registering on your website, the customer must first be asked again whether he really wants to register for the newsletter. Only when the customer confirms, the confirmation is considered valid.
Automatic processing
TYRIOS takes over the automatic processing of the double opt-in registration for you. For this purpose, the system automatically sends a corresponding email to the newsletter recipient after registration. You can change and process this email at any time. You can find it here:
- Go to the customer area > System > Manage mail templates.
- Here you will find an entry for "Newsletter - Confirmation Mail". You can now manage the template via "Edit template".
When editing the template, make sure that the link to the confirmation remains intact. You will find the available patterns listed under the editor.
Attention: Consent may expire automatically
When using the newsletter system, make sure that you regularly send a newsletter to your customers. If you have not sent a newsletter for a longer period of time, you can no longer assume that the double opt-in is valid. The consent may have lapsed. The period is not regulated by law. However, judgments speak of 6 months. Our recommendation is therefore that you should send a newsletter at least once a quarter to be on the safe side.
TYRIOS does not automatically remove the double opt-in, as there is no legal regulation to date. However, it is possible to store an individual script that is automatically activated here. This way you can be on the safe side. Please contact us specifically if you need this.
